| Welcome to Pornobible.com. To ensure that you enjoy the highest standards
of quality and service during your visits to Pornobible, we encourage you
to read through the following information before you register. These legal
notices spell out the terms and conditions to which Members are expected
to adhere to. When you are finished reading these notices, you may complete
the registration process and become a member. |

Privacy
| Any information you disclose to us as part of this registration will
not be released to third parties. However, we may monitor your use of Pornobible(service)
and use or disclose any information gathered as part of our evaluation
of the service to satisfy any law, regulation or other government request,
and to operate the Service properly and efficiently. Weiser & Company.("W&C")
may, in it's sole discretion, develop and use consumer research based on
Subscriber's use of the Service. All marketing information shall be subject,
in all cases, to compliance with the applicable rules and regulations of
the Communications Commission, and other relevant laws and regulations,
as the same may be amended from time to time. |

| ALL MATERIALS, INCLUDING MESSAGES, AND OTHER COMMUNICATIONS, CONTAINED
AT Pornobible.COM ARE INTENDED FOR DISTRIBUTION EXCLUSIVELY TO CONSENTING
ADULTS IN LOCATIONS WHERE THE MATERIALS, MESSAGES AND OTHER COMMUNICATIONS
CONTAINED AT Pornobible.COM DO NOT VIOLATE ANY COMMUNITY STANDARDS OR ANY
FEDERAL, STATE OR LOCAL LAW OR REGULATION OF THE UNITED STATES OR ANY OTHER
COUNTRY. NO PERSONS UNDER THE AGE OF TWENTY ONE (21) YEARS MAY DIRECTLY
OR INDIRECTLY VIEW OR POSSESS ANY OF THE CONTENTS OF Pornobible.COM OR PLACE
ANY ORDERS FOR ANY GOODS OR SERVICES ADVERTISED AT OR IN Pornobible.COM.
YOU HEREBY ACKNOWLEDGE THAT MATERIALS PRESENTED AT AND/OR DOWNLOADABLE
FROM Pornobible.COM INCLUDE EXPLICIT VISUAL, AUDIO, AND/OR TEXTUAL DEPICTIONS
OF NUDITY AND HETEROSEXUAL, BI-SEXUAL, AND/OR TRANSEXUAL SITUATIONS OF
A SEXUAL NATURE, THAT YOU ARE FAMILIAR WITH MATERIALS OF THIS KIND, AND
THAT YOU ARE NOT OFFENDED BY SUCH MATERIALS.
YOU HEREBY FURTHER AFFIRM AND WARRANT THAT YOU ARE CURRENTLY OVER THE
AGE OF TWENTY ONE (21)YEARS AND ARE CAPABLE OF LAWFULLY ENTERING INTO THIS
AGREEMENT.

Terms of Service

1. General Rules and Definitions
| 1.1 |
This Subscriber Agreement, which includes the Operating Rules constitutes
Subscriber's Agreement with Pornobible, an Adult service of Weiser &
Company, Inc. with respect to Subscriber's use of the service. Subscriber
must agree to abide by all of the terms and conditions contained in this
Subscriber Agreement in order to become or remain an authorized Subscriber
of the Service. |

To indicate agreement with the terms and conditions of this Subscriber
Agreement, Subscriber must click the "Accept" button at the end
of this Subscriber Agreement. You will not be allowed to register before
clicking that button. Feel free to read and reread the Subscriber Agreement
as often as you want before clicking the "Accept" button. W&C
reserves the right, at its discretion, to change, modify, add or remove
portions of this Subscriber Agreement at any time. Notification of changes
in service will be posted on the Service, sent via e-mail, or postal mail.
Occasionally W&C may ask you to accept the terms of such changes to
continue using the service. |

IF THE SUBSCRIBER AGREEMENT OR ANY FUTURE CHANGES ARE UNACCEPTABLE
TO SUBSCRIBER, OR CAUSE SUBSCRIBER TO NO LONGER BE IN COMPLIANCE WITH THE
SUBSCRIBER AGREEMENT, SUBSCRIBER MAY CANCEL SUBSCRIPTION BY ONLINE
FORM (SEE SECTION 9 REGARDING TERMINATION OF SERVICE). SUBSCRIBER'S
CONTINUED USE OF THE SERVICE NOW, OR FOLLOWING THE POSTING OF NOTICE OF
ANY CHANGES IN THESE OPERATING RULES, WILL CONSTITUTE A BINDING ACCEPTANCE
BY SUBSCRIBER OF SUCH RULES, CHANGES, OR MODIFICATIONS. |

W&C may change, suspend or discontinue any aspect of the Service
at any time, including the availability of any Service feature, database,
or content. W&C may also impose limits on certain features and services
or restrict Subscriber access to parts or all of the Service without notice
or liability. |
| 1.5 |
I agree that I shall at no time access, view, download, receive or
otherwise use, or cause or enable others to access, view, download, receive
or otherwise use materials, directly or indirectly in places which the
Company does not authorize such access, viewing, downloading, receipt or
other use. I hereby acknowledge and agree that no materials from any parts
of Pornobible.com are authorized, and no materials are intended, by the
Company to be accessed, viewed, downloaded or used by, or transmitted,
broadcast or otherwise disseminated to any person or entity located in
any and all areas prohibited by law. I agree that any and all unauthorized
access, viewing, downloading, receipt, duplication or other use of materials
from Pornobible.com, in which I am directly or indirectly involved, including,
but not limited to accessing, viewing, downloading, receiving or other
use of materials in PROHIBITED AREAS in any manner shall constitute intentional
infringement(s) of Pornobible.com's and potentially other's intellectual
property rights and other rights in such materials and shall further constitute
a violation of Pornobible.com's trademark and other rights, including, but
not limited to, rights of privacy. |

I agree to be personally liable and fully indemnify Pornobible.com for
any and all damages directly, indirectly and/or consequentially resulting
from my attempted or actual unauthorized downloading or other duplication
of materials from Pornobible.com alone, or with or under the authority of,
any other person(s), including, without limitation, any governmental agency(ies),
wherein such damages include, without limitation, all direct and consequential
damages directly or indirectly resulting from unauthorized downloading
of materials from Pornobible.com including, but not limited to, damages
resulting from loss of revenue, loss of property, fines, attorney's fees
and costs, including, without limitation, damages resulting from prosecution
and/or governmentally imposed seizure(s), forfeiture(s), and/or injunction(s). |

2. W&C Content and Subscriber Submissions
| 2.1 |
The contents of the W&C Adult service are intended for the personal,
noncommercial use of its registered Subscribers. All materials published
on Pornobible.com (including, but not limited to news articles, photographs,
images, illustrations, audio clips and video clips, also known as "The
Content") are protected by copyright and other intellectual property
laws, and are owned or controlled by W&C, or the party credited as
the provider of the content, software, or other materials. Subscriber shall
abide by all additional copyright or other notices, information, or restrictions
appearing in conjunction with any Content accessed through the Service. |

The Service is protected by copyright as a collective work and/or compilation,
pursuant to U.S. copyright laws, international conventions, and other copyright
laws. Except as set forth in Section 2 of this Subscriber Agreement, Subscriber
may not modify, adapt, translate, exhibit, publish, transmit, rent, lease,
participate in the transfer or sale of, reproduce (except as provided in
this section of the Subscriber Agreement), create derivative works from,
distribute, perform, display, reverse engineer, decompile or dissemble,
or in any way exploit, any of the Content, software, materials, or Service
in whole or in part. |

Subscriber may download or copy the Content and other downloadable
items displayed on this Service for personal, noncommercial use only, provided
that Subscriber maintains all copyright and other notices contained in
such Content. Copying or storing of any Content for other than personal,
noncommercial use is expressly prohibited without the prior written permission
from the Rights and Permissions Department, or
the copyright holder identified in the individual Content's proprietary
notices including copyright notice. |

W&C hereby grants you a limited, non-exclusive and non-transferrable
license to use graphic files, audio files, video files, text, hyperlinks,
interlinks, search engines, and other software associated with authorized
Subscriber use of Pornobible.com which W&C provides ("Content")
during the period in which you are a current Subscriber in good standing.
The license granted to you herein grants to you no rights to use such content
except as set forth herein. This license will immediately terminate automatically
if you fail to comply with the limitations described herein, breach any
other provision of this Agreement, cease, for any reason, to be a Subscriber
in good standing, or are notified of its termination by the Company or
its authorized agent(s). You agree that upon such termination, you will
immediately destroy all copies of the Materials in your possession. |

"Pornobible.com" is a service mark of W&C. All rights
are reserved. |

3. Forums and Discussions
| 3.1 |
Subscriber shall not upload to, or distribute or otherwise publish
through, the Service any Content which is libelous, defamatory, obscene,
pornographic, profane, sexually explicit, abusive, or otherwise violates
any law. Please use your best judgment and be respectful of other individuals
using the bulletin boards. Do not use vulgar, abusive or hateful language.
Bulletin boards within these sites and services are provided to give our
users an interesting and stimulating forum in which they can express their
opinions and share their ideas. W&C does not endorse the opinions placed
on these bulletin boards. Subscriber acknowledges that any submissions
(e.g. Feedback, E-Mail) may be edited, removed, modified, published, transmitted,
and displayed by W&C. In addition, Subscriber warrants that all moral
rights in any uploaded materials have been waived. |
| 3.2 |
The Forums shall be used only in a noncommercial manner. Subscriber
shall not, without the expressed approval of W&C, distribute or otherwise
publish any material containing any solicitation of funds, advertising
or solicitation for goods or services, or to promote websites or online
services which are competitive with W&C and the Service. You agree
that you will not submit any ideas for stories, features, designs, scripts,
merchandise or publication of any type. |

While W&C does not and cannot review every message posted by Subscribers
in the Forums and is not responsible for any content of these messages,
W&C reserves the right to delete, move, or edit messages that it, in
its sole discretion, deems are in violation of the law (including trademark
and copyright law), or this Subscriber Agreement, or are abusive, defamatory,
obscene, or otherwise unacceptable. Subscribers shall remain solely responsible
for the content of their messages. |
| 3.4 |
If the W&C should at any time provide any service which enables
Subscribers to communicate with or otherwise share information with other
Subscribers or persons providing any kind or service to Subscribers, you
agree not to submit, publish, display, disseminate, or otherwise communicate
any defamatory, inaccurate, abusive, threatening, offensive, or illegal
material while connected to or otherwise directly or indirectly using Pornobible.com
or other services provided to you by W&C. Transmission of such material
or any material that violates any federal, state, or local law in the United
States or anywhere else in the world, is strictly prohibited and shall
constitute a material breach of this Agreement entitling Weiser & Company
to immediately terminate all rights to access Pornobible.com. You are solely
responsible for all information which you submit, publish, display, disseminate
or otherwise communicate through Pornobible.com even if a claim should arise
after termination of service. If W&C provides any such service described
herein, you agree that all messages and other communications by you shall
be deemed to be readily accessible to all other Subscribers who are authorized
to access Pornobible.com and agree that all such messages and other communications
shall not be deemed to be private or secure. Regardless of whether W&C
provides any type of service described herein, you agree that you have
hereby been informed and noticed that any and all messages and other communications
which you submit to Company directly or through Pornobible.com can be read
by the operators and/or other agents of Company, whether or not they are
the intended recipient(s). |

4. Access and Availability of Service and Links
| 4.1 |
Pornobible contains links to other related World Wide Web Internet sites,
resources, and sponsors of W&C. Since W&C is not responsible for
the availability of these outside resources or their contents, Subscriber
should direct any concerns regarding any external link to it's site administrator
or Webmaster. |
| 4.2 |
W&C does not screen or endorse advertisements or communications
submitted to Pornobible.com by third-party licensees, advertisers, or subscribers
for electronic dissemination through Pornobible.com. Subscribers are therefore
advised to use their own judgment to evaluate all advertisements and other
communications available at or through the use of Pornobible.com prior to
purchasing goods and/or services described at Pornobible.com or otherwise
responding to any communication at Pornobible.com. |

5. Representations and Warranties
| 5.1 |
Subscriber represents, warrants, and covenants (a) that no materials
of any kind submitted through Subscriber's account or W&C's use thereof
in accordance with the terms and conditions of this Subscriber Agreement,
will (1) violate, plagiarize, or infringe upon the rights of any third
party, including copyright, trademark, privacy or publicity, moral rights,
contract or other personal or proprietary rights; or (2) contain libelous
or otherwise unlawful material; (3) constitute false or misleading indications
of origin or statements of fact; (4) slander, libel or defame any person
or entity; (5) cause injury of any kind to any person or entity; or (6)
violate any applicable laws, rules, regulations or other governmental regulations;
and (b) that the Subscriber is at least 21 years old. Subscriber hereby
indemnifies, defends and holds W&C and Pornobible, and all officers,
directors, owners, agents, information providers, affiliates, licensors
and licensees (collectively, the "Indemnified Parties") harmless
from and against any and all liability and costs incurred by the Indemnified
Parties in connection with any claim arising out of any breach by Subscriber
or any User of Subscriber's account of the Subscriber Agreement or the
foregoing representations, warranties and covenants, including, without
limitation, reasonable attorneys' fees. Subscriber shall cooperate as fully
as reasonably required in the defense of any claim. W&C reserves the
right, at its own expense, to assume the exclusive defense and control
of any matter otherwise subject to indemnification by Subscriber. |
| 5.2 |
Any liability of Company, including without limitation any failure
of performance, error, omission, interruption, deletion, defect, delay
in operation or transmission, communications line failure, theft or destruction
or unauthorized access to, alteration of, or use of records, whether for
breach of contract, tortious behavior, negligence, or under any other cause
or action, shall be strictly limited to the amount of membership fee paid
by or on behalf of the subscriber to Weiser & Company for the preceding
month. Some states do not allow the limitation or exclusion of liability
for incidental or consequential damages, so the above limitation or exclusion
may not apply to you. |
| 5.3 |
Neither W&C nor Pornobible.com represent or endorse the accuracy
or reliability of any advice, opinion, statement, or other information
displayed, uploaded, or distributed through the service by any Subscriber,
information provider or any other person or entity. Pornobible.COM, THE
SERVICE, THE ACCESS SOFTWARE (DEFINED HEREIN) AND ANY MATERIALS PROVIDED
BY W&C OR THIRD PARTIES THROUGH Pornobible.COM AND THE SERVICE ARE PROVIDED
"AS IS." W&C MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS
TO THE MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE,
NON-INFRINGEMENT OR ANY OTHER WARRANTY, CONDITION, GUARANTY, OR REPRESENTATION,
WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED
TO THE ACCURACY OR USEFULNESS OF ANY MATERIALS PROVIDED THROUGH Pornobible.COM
AND THE SERVICE. W&C SHALL NOT BE RESPONSIBLE TO THE SUBSCRIBER OR
ANY THIRD PARTIES FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE
OR EXEMPLARY DAMAGE OR LOSS INCURRED IN CONNECTION WITH USE OF Pornobible.COM,
THE SERVICE, THE ACCESS SOFTWARE OR ANY OF THE MATERIALS PROVIDED BY W&C
OR THIRD PARTIES THROUGH Pornobible.COM AND THE SERVICE, OR ANY DAMAGE OR
LOSS INTERRUPTIONS, DELETIONS OF FILES, ERRORS, DEFECTS, DELAYS IN PERFORMANCE
OF Pornobible.COM, THE SERVICE OR THE ACCESS SOFTWARE, REGARDLESS OF THE
CLAIM AS TO THE NATURE OF THE CAUSE OF ACTION, EVEN IF W&C HAS ADVISED
OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. |
| 5.4 |
Subscriber hereby acknowledges that use of the Service is at Subscriber's
sole risk. The entire risk as to the quality and performance of the Materials
and all services provided by Weiser & Company is borne by you. Should
the Materials or any other service provided by Weiser & Company prove
defective and/or cause any damage to your computer or inconvenience to
you, you, and not Weiser & Company, assume the entire cost and all
damages which may result from any and all such defects. This disclaimer
of warranty constitutes an essential part of the Agreement. Some states
do not allow exclusions of an implied warranty, so this disclaimer may
not apply to you and you may have other legal rights that vary from state
to state or by jurisdiction. Under no circumstances and under no cause
of action or legal theory, shall Weiser & Company, its suppliers, licensees,
resellers, or other subscribers, or their suppliers, licensees, resellers
or subscribers be liable to you or any other person for any indirect, special,
incidental, or consequential damages of any character including, without
limitation, damages for loss goodwill, work stoppage, computer failure
or malfunction, or any and all other commercial damages resulting from
any use of Materials or other use of Pornobible.com. |
| 5.5 |
Weiser & Company is not liable for damages resulting from disseminating,
failing to disseminate, or incorrectly or inaccurately disseminating any
Materials, data, advertisement or other communication at or through Pornobible.com. |

6. Registration and Security
| 6.1 |
As part of the registration process, Subscriber will select a Password
and Subscriber name. Subscriber shall provide Pornobible.COM with accurate,
complete, and updated registration information. Failure to do so shall
constitute a breach of this Agreement, which may result in immediate termination
of Subscriber's account. Subscriber may not (1) select or use a screen
name of another person with the intent to impersonate that person; (2)
use a name subject to the Rights of any person other than Subscriber without
authorization; or (3) use a screen name that W&C, in its sole discretion,
deems offensive. |
| 6.2 |
(a) Subscriber shall notify W&C of any known or suspected unauthorized
use(s) of Subscriber's account, or any known or suspected breach of security,
including loss, theft, or unauthorized disclosure of Subscriber's password
or credit card information. (b) Subscriber shall be solely responsible
for maintaining the confidentiality of Subscriber's password. Subscriber
will never be required to reveal Subscriber's password to any representative
or agent of W&C, it's owners or agents. |
| 6.3 |
Payment for the services provided to you at and/or through Pornobible.com
may be made by automatic credit card or check debit and you hereby authorize
Weiser & Company and its agents to transact such payments on your behalf.
You agree not to report as lost or stolen any credit card which you have
used in conjunction with payment to Pornobible.com, or as unauthorized any
charge by Pornobible.com, for any goods or services, including subscription,
for which you do not have good reason to believe is, in fact, lost, stolen
or unauthorized. You hereby agree that any such fraudulent reporting of
a lost or stolen credit card used to obtain goods or services from Pornobible.com
or any fraudulent reporting of an unauthorized charge to Pornobible.com
on your credit card which has been made by you or anyone under your authority,
at a time when a charge or other obligation for payment for goods and/or
services to Pornobible.com remains outstanding at the time of such fraudulent
reporting, you shall be liable to Pornobible.com for liquidated damages
of $25,000.00. The liability for liquidated damages specified in this Paragraph
shall not limit any other liability you may have for breach(es) of any
other terms, conditions, promises and warranties set forth in this Agreement. |
| 6.4 |
Subscriber must be 21 years old or older to subscribe to the Service.
As such, Pornobible.com Subscriber may NOT share Subscriber's ID and Password
with others. |
| 6.5 |
Each Subscriber is responsible for all usage or activity on their Pornobible.COM
account. In the event that more then one person attempts to access the
service using the same Pornobible.COM Subscriber's ID and Password, said
ID will be canceled. Any fraudulent, abusive, or otherwise illegal activity
may be grounds for termination of Subscriber's account, at W&C's sole
discretion, and Subscriber may be referred to appropriate law enforcement
agencies. |
| 6.6 |
Subscriptions may not be assigned or transferred to any other person
or entity. Subscriber must promptly inform Company of the following: changes
in the expiration date of any credit card used in connection with Pornobible.com;
changes in home or billing address; and any apparent breaches of security,
such as loss, theft, or unauthorized disclosure or use of Subscriber's
ID and Password. Until Weiser & Companyis notified, by conventional
mail, web site form, or by telephone to Pornobible.com's Customer Service
Department at (888) 968-5834, during normal business hours of a breach
in security, the Subscriber will remain liable for any unauthorized use
of Pornobible.com. Upon request, Subscribers will be given access to billing
records that support charges for use of Pornobible.com. |
| 6.7 |
Subscription to Pornobible.com may be terminated at any time, and without
cause, by either Weiser & Companyor Subscriber upon notification of
the other by electronic or conventional mail, or by telephone. You agree
to be personally liable for all charges incurred by you during or through
the use of Pornobible.com. Your liability for such charges shall continue
after termination of your membership for any reason. |
| 6.8 |
Subscribers are responsible for providing all personal computer and
communications equipment necessary to gain access to Pornobible.com. Access
to and use of Pornobible.com is through the use of a password. Each Subscriber
must keep his password strictly confidential. For security reasons, Pornobible.com
will not release passwords. Unauthorized access to Pornobible.com is a breach
of this Agreement and a violation of law. |

7. Fees and Payments
| 7.1 |
W&C reserves the right at any time to charge fees for access to
portions of the service or the service as a whole. In the event that W&C
so elects, it shall post notice in the Service Information Area. Subscriber
shall pay all fees and charges incurred through Subscriber's account at
the rates in effect for the billing period in which such fees and charges
are incurred, including, but not limited to charges for any products or
services offered for sale through the Service by W&C or by any other
vendor or service provider. All fees and charges shall be billed to and
paid for by Subscriber. Subscriber shall pay all applicable taxes relating
to use of the Service through Subscriber's account. Subscriber's right
to use the Service is subject to any limits established by W&C in its
sole discretion. |
| 7.2 |
Subscription Fees. The Subscriber is responsible for paying periodic
subscription fees according to the then-current billing terms. Subscription
fees are non-refundable. For your convenience and satisfaction, all memberships
will automatically renew upon expiration unless your subscription is cancelled
at least 24 hours prior to expiration. The cost of renewal will not exceed
monthly membership costs at time of members' initial subscription. Cost
of renewal will not be affected by any increase in Pornobible.com subscription
rates. Rates are $19.95 per month or $50.00 per quarter. All membership
cancellations can take place by visiting our MEMBER SERVICES area. |
| 7.3 |
Other fees and/or charges for goods and services ordered at, through
and/or from Pornobible.com and its licensees may apply |

8. Software Licenses
| 8.1 |
Subscriber shall have no rights to the proprietary software and related
documentation, or any enhancements or modifications thereto, provided to
Subscriber to access the Service ("Access Software"). Subscriber
may not sublicense, assign or transfer any licenses granted by W&C,
and any attempt at such sublicense, assignment or transfer is void. Subscriber
may copy such software for archival purposes only. Subscriber may not copy,
distribute, modify, reverse, engineer, or create derivative works form
Access Software. |

9. Termination
| 9.1 |
Subscriber may terminate Subscriber's account at any time by selecting
to cancel via online form. Upon termination,
Subscriber will receive confirmation via email that the request was processed,
and Subscriber's access will be suspended within one week. Subscriber is
responsible for all charges for the duration of their subscription month
and is responsible for all charges incurred up to the time the account
is deactivated. |
| 9.2 |
W&C may, in its sole discretion, terminate or suspend Subscriber's
access to all or part of the Service for any reason, including, without
limitation, breach of the Subscriber Agreement, or assignment of the Subscriber
Agreement by Subscriber. |

10. Miscellaneous
| 10.1 |
This Subscriber Agreement has been made in and shall be construed and
enforced in accordance with California law. Any action to enforce this
agreement shall be brought in the federal or state courts located in California. |
| 10.2 |
Notices from Pornobible.com to Subscribers may be given by means of
e-mail, by general posting on Pornobible.com, or by conventional mail. Communications
from you to the Weiser & Company may be made by e-mail, conventional
mail or telephone. All questions, complaints, or notices to Pornobible.com
may be sent in the following manner:
a. by means of E-Mail; or
b. by telephone to Pornobible.com's Customer Service Department during
normal business hours to 800-728-7271.

11. Legal

This Agreement contains the entire agreement between the Subscriber
and W&C regarding Subscribers' use of Pornobible.com, materials and
all materials directly and indirectly related thereto. This Agreement supersedes
all prior written and oral understandings, writings, and representations
and may only be amended upon notice by W&C. This Agreement shall be
governed by and construed under the laws of the State of California and
the United States as applied to agreements between California State residents
entered into and to be performed within the State of California, except
as governed by Federal law. The application of the United Nations Convention
of Contracts for the International Sale of Goods is expressly excluded.
If any provision of this Agreement is held to be unenforceable for any
reason, such provision shall be reformed only to the extent necessary to
make it enforceable. Unless otherwise explicitly stated, the provisions
of this Agreement shall surviveits termination. |
